GENERAL TERMS AND CONDITIONS

 
§ 1 SCOPE AND PROVIDER

 

1.1 General Terms and Conditions (GTC) apply to all orders for goods and services that a consumer places via the online shop www.amuseliebe.at Managing Director Kim Wyman. Customers can contact us on the service hotline +44 12 2391 1020 or by email at service@amuseliebe.shop

1.2 Consumers within the meaning of the law (§ 13 BGB) and these General Terms and Conditions are natural persons with whom we enter into business relationships without this being primarily attributable to a commercial or independent professional activity. 

1.3 If you are under 18 years of age, the involvement of your legal guardian is required. 

1.4 The contract language is exclusively German. 

1.5 You can access and print out the currently valid General Terms and Conditions on the website.

 
§ 2 CONCLUSION OF CONTRACT

 

2.1 The presentation of goods in the online shop does not constitute a binding application for the conclusion of a purchase contract. Rather, it is a non-binding invitation to order goods in the online shop.

2.2 By clicking the “Order now with payment” button, you are making a binding purchase offer (§ 145 BGB).

2.3 After receipt of the purchase offer, you will receive an automatically generated email in which we confirm that we have received your order (confirmation of receipt). This confirmation of receipt does not constitute acceptance of your purchase offer. A contract is not concluded through confirmation of receipt.

2.4 A purchase contract for the goods is only concluded when we expressly declare acceptance of the purchase offer or when we send the goods to you - without a prior express declaration of acceptance.

 

§ 3 PRICES

 

The prices stated on the product pages include statutory VAT and other price components and do not include VAT. the respective shipping costs.

 
§ 4 DELIVERY AND RESERVATION OF SELF-DELIVERY

 

4.1 If not all of the products ordered are in stock, we are entitled to make partial deliveries at our expense, provided this is reasonable for you.

4.2 We expressly reserve the right to withdraw from the contract if, through no fault of our own, we are unable to deliver the ordered goods because the supplier does not fulfill his contractual obligations. In such a case, we will inform you immediately about the non-deliverability of the goods and immediately refund any payments that have already been made to you.

 
§ 5 RETENTION OF TITLE

 

The delivered goods remain our property until full payment. Prior to the transfer of ownership, pledging, transfer as security, processing or redesign is not permitted without our express consent.

 

§ 6 SHIPPING

 

6.1 All prices shown include statutory sales tax and other price components without the applicable delivery and shipping costs.

6.2 When the website is updated, all previous prices and other information about goods become invalid. The version valid at the time of the order is relevant.

6.3 When purchasing and subsequently shipping our goods, we charge the following fees: The costs for shipping to other countries will be clearly communicated to you in the FAQ or on the order page.

 

§ 7 PAYMENT TERMS

 

The following payment options are offered for all orders:

Purchase on account with Klarna

When you purchase on account with Klarna, you first receive the goods and have 14 days to pay them to Klarna. When the goods are dispatched, the invoice will be sent to you by email. You will receive the payment information separately from Klarna by email. Please only transfer the invoice amount to the bank details provided by Klarna. You can view your current payment status at any time in the Klarna app or the Klarna customer portal at www.klarna.com/de by entering your email address.

Please note that “Billing with Klarna” is only available for consumers who are at least 18 years old and for private customers. You can find the complete terms and conditions for purchasing on account here. Pay quickly and securely with “PayPal”. This payment method is free of charge for you. To use PayPal you need a valid PayPal account in which your bank or credit card details are stored. After successful payment you will be redirected back to our online shop.

You can order conveniently and easily with your credit card. We accept Visa, Mastercard, American Express and Discover. Your credit card details are transmitted securely using SSL encryption. There are no additional fees when paying by credit card.

§ 8 CANCELLATION POLICY

 

If you are a consumer within the meaning of Section 13 of the German Civil Code (BGB), i.e. you make the purchase for purposes that cannot predominantly be attributed to your commercial or independent professional activity, you have a right of withdrawal in accordance with the following provisions.

RIGHT OF CANCELLATION

We hope you are satisfied with your order. If this is not the case, you can easily return your purchased items within 14 days of delivery. Please note that we only accept goods back if they are unworn and in perfect condition. 

If you have successfully completed payment, we confirm that you agree to all return conditions.

by means of a clear explanation (e.g. b a letter sent by post or email) informing you of your decision to withdraw from this contract. You can use the attached sample cancellation form, although this is not mandatory. In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.

 
CONSEQUENCES OF WITHDRAWAL

If you cancel this contract, we will refund to you all payments we have received from you, with the exception of any additional costs arising from you choosing a method of delivery other than the cheapest standard delivery offered by us , to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier. You must return or hand over the goods to us or to immediately and in any case no later than fourteen days from the day on which you notify us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired.

You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to the handling of the goods other than what is necessary to establish the nature, characteristics and functionality of the goods.

§ 9 SPECIAL NOTE

 

9.1 The right of withdrawal does not apply to the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer (e.g. b individual ballerinas, self-designed dirndls, ribbon skirts and jackets), when delivering sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal was removed after delivery or when delivering audio or video recordings or computer software a sealed package if the seal has been removed after delivery. Cash payment, return or denomination of a gift voucher is not possible.

9.2 Some products have a yellow seal with numbering and are shipped that way. When trying on the goods, please be careful not to damage or remove the seal. Only products with the original seal have a 14-day right of withdrawal.

9.3 Please avoid damage and contamination. If possible, please send the goods back to us in the original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging in order to avoid claims for damages due to damage caused by inadequate packaging.

 

§ 10 WARRANTY

 

The statutory warranty provisions apply.

 
§ 11 DATA PROTECTION POLICY

 

We process data in accordance with the applicable Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). Furthermore, reference is made to the information in the data protection declaration.

 

§ 12 LIABILITY

 

12.1 Unlimited liability: We are liable for intent and gross negligence. We are liable for slight negligence in accordance with the Product Liability Act as well as for damage resulting from injury to life, body or health of persons.

12.2 Limitation of liability: In the event of slight negligence, we are only liable for the breach of an essential contractual obligation, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligation). This limitation of liability also applies to our vicarious agents.

 

§ 13 FINAL PROVISIONS

 

13.1 These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Hong Kong and the United Kingdom.

13.2 The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.

13.3 If one or more provisions of these General Terms and Conditions are ineffective, this does not result in the invalidity of the entire contract. The ineffective regulation will be replaced by the applicable legal regulation.
